No, it isn't, for several reasons. First: assault is the threat of battery, or actual harm. Second, battery only occurs when the actions are not performed in a legal capacity. While you may disagree with his actions, they were entirely legal. Please research the facts before you post.

Try again. Johannes Mehserle was an officer for BART, or Bay Area Regional Transport. He was tried and convicted by a jury of his peers, served his sentence, and released according to law. What more would you prefer, a public lynching?

It is unknown if they actually entered the country at all, as stated in the article at the time of their arrest and in the seeded article. Second, the crime against the state was not given. We may assume that it was for painting the state in an unfavorable light, but we do not know.

While I am not sure that this is the proper response, it certainly did work for the Russians when their embassy was taken in Iran years ago.

These sort of actions must be responded to by the President. I sincerely hope our President demands to know the exact circumstances regarding their arrest, specifically the vague crime against the state and their wherabouts when taken into custody.
